For provinces (autonomous regions) that fail to promote mechanism construction, the compensation funds will be gradually deducted from the second and third years of the pilot program and used to reward advanced regions, so as to strengthen the role of restraint and reflect the principle of clear rewards and punishments.

 

Iv. Organizational guarantee

 

(1) Clear division of responsibilities among departments. The four departments shall be responsible for promoting the construction of ecological compensation mechanism. According to their respective responsibilities, they shall strengthen the guidance of local pilot work, further promote various key tasks, timely evaluate the ecological compensation mechanism and improve relevant compensation measures. The Ministry of Finance is responsible for coordinating the implementation of the plan, guiding the arrangement of funds and supervising the use of funds, and organizing the implementation of comprehensive budget performance management together with relevant departments. The Ministry of Ecology and Environment, the Ministry of Water Resources and the State Forestry and Grassland Administration shall, according to their respective functions and duties, guide local governments to carry out ecological environment protection and restoration, soil and water conservation, water resources management, afforestation, carbon sink project development and trading, etc. The Ministry of Ecology and Environment is responsible for timely providing assessment data such as water quality, achievement of emission reduction targets and tasks of each province (region), as well as specific work such as establishing and operating a management platform for horizontal ecological compensation mechanism. The Ministry of Water Resources is responsible for timely providing assessment data of water resources amount, water consumption, water-saving efficiency and soil and water conservation in each province (region). The State Forestry and Grassland Administration is responsible for providing timely information on forest, wetland and grassland areas. 2. Strictly fulfilling the responsibilities of local entities. All provinces (autonomous regions) along the Yellow River should fulfill their primary responsibility for ecological protection and high-quality development of the Yellow River Basin, strengthen planning and implementation, and make clear the division of responsibilities. All provinces should strengthen communication and coordination, actively carry out inter-provincial consultation and negotiation, promote the early implementation of the compensation mechanism, constantly expand diversified and market-oriented compensation mechanisms, and timely and fully implement the compensation funds in accordance with the scope, standards and policies of ecological compensation stipulated in the agreement. We will actively promote the construction of compensation mechanisms to be extended to cities and counties where river basins are located. In view of the actual situation in this region, measures for protection and governance should be formulated centering on prominent ecological and environmental problems. Important ecological system protection and restoration should be carried out in the upstream to enhance self-restraint capacity. In the middle reaches, soil and water conservation and pollution control should be done well, and serious polluted tributaries should be strengthened. The lower reaches of the River should focus on the protection of the wetland system in the Yellow River Delta to promote the healthy development of river ecosystems and enhance biodiversity. 3. Strengthening performance management. The four departments signed provincial agreements with nine provinces (autonomous regions) along the Yellow River to clarify the rights and responsibilities of all departments and local governments in jointly promoting the horizontal ecological compensation mechanism for the whole Yellow River basin, and reasonably determine the work objectives, compensation fund raising and allocation and use measures. We will make the performance of compensation funds more public and make the use of compensation funds more transparent. 4. Making solid progress in coordinated governance. The four departments shall jointly establish a stable working contact mechanism, promote information sharing on fund budget implementation, water quality monitoring and water resource monitoring, strengthen guidance on local work, establish a mutual reporting mechanism, and jointly study and solve major problems encountered in the promotion of ecological compensation mechanism. Focusing on the systematization, integrality and coordination of basin protection and governance, and giving full play to the role of management platform, the upper, middle and lower reaches of provinces (autonomous regions) should establish effective inter-regional communication and consultation mechanism, carry out joint consultation on environmental impact assessment of major engineering projects and joint prevention of environmental pollution emergency, and jointly promote basin protection and governance. Jointly carry out water quality monitoring of transboundary sections to ensure that monitoring data are authoritative and accurate. We will establish a coordination mechanism among river basin management agencies, provinces (regions) and cities across regions, improve the mechanism of river and lake chiefs, and strengthen joint prevention and control of ecological environmental protection and restoration and joint law enforcement within river basins.
